J1 EXCHANGE VISITORS

Aliens who enter the U.S. as participants in an exchange-visitor program approved by the U.S. government are classified as J1 nonimmigrants. Aliens participating in such programs may engage in teaching, lecturing, studying, observing, conducting research, consulting, demonstrating special skills, or receiving training. The J1 for trainee is only valid for a maximum of 18 months and usually cannot be extended.

Nationals from certain countries and those who participate in certain programs may be subject to a 2 year home stay requirement – meaning after the program is over they must return to their home country – unless they can obtain a waiver. On the positive side, J1 visa status is pretty easy to obtain and also can be secured fairly quickly.

If you are interested in sponsoring an employee for J1 visa status or your company is interested in sponsoring you for the J1 visa, please contact our immigration attorneys and we will be happy to discuss this visa category with you.
